Delhi HC adjourns several DAS Phase III cases till 18 Oct

Delhi High Court has adjourned many digital addressable system (DAS) Phase III cases until 18 October. The single bench of Justice Sanjeev Sachdeva has directed the parties including the Ministry of Information & Broadcasting (MIB) to differentiate the cases that challenge the DAS notification from the ones that are about DAS Phase III deadline. This batch of cases involves more than 30 petitions. Most of them pertain to DAS Phase III deadline; however, some petitions deal with other issues related to DAS. Once the cases are differentiated, the ones challenging the notification will be dealt with by a division bench while the remaining cases related to DAS Phase III deadline will continue to be heard by the bench of Justice Sachdeva. Earlier, the bench of Chief Justice Rohini G and Justice Sangita Dhingra Sehgal had reserved judgment in two DAS Phase III cases, namely Nasik Zilla Cable Operators’ Federation and Radiant Digitek Networks. It is expected to pronounce its judgment on the cases on 7 October. In the hearing on 26 September, the petitions involving IndusInd Media and Communications Ltd (IMCL) and Bhima Riddhi Digital Networks were untagged from DAS Phase III cases and adjourned sine die as they relate to the constitutional validity of certain provisions of Maharashtra Entertainment Tax. In its hearing on 8 September, the bench had re-notified the five cases to 26 September, as the petitioners in Rajasthan Cable Operators’ Foundation and Radiant Digitek were not represented.

On 7 September, the Delhi HC had adjourned the hearing in the first batch of DAS Phase III cases until 5 October due to hearing the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (COFEPOSA), 1974. This batch of cases include Sree Devi Digital Systems, The Rohtak Cable Operator, AP MSOs Welfare Federation, Multi System Operator Welfare Association, Sai Big Star Welfare Association, Federation of Telangana MSO, DEN Manoranjan Satellite, Victory Digital, Sri Chowdeshwary Cable Network, Shyam Baba Cable Network, Panchajanya Media, Bharat Digital Cable Network, Nashik Zilla Cable Operators Association, Bhima Riddhi Digital Services and Yogesh Cable Networks. Delhi High Court is the designated court for all cases related to DAS Phase III. The Supreme Court had transferred all DAS Phase III cases to Delhi High Court following a petition filed by the MIB. DAS Phase III implementation has been stalled by court cases. The cases have dragged on in various courts, leading to a delay in its implementation. Even as the cases continue, the Phase IV deadline of 31 December is approaching fast.
