Limited punitive action taken against 31 TV channels in 11 years
As many as 31 TV channels were asked to stop transmission for specific period of time ranging from one day to 60 days including news channel for 30 days between 2005 and 2016.
Minister of State for Information and Broadcasting Ministry Rajyavardhan Rathore told the Parliament that 22 private television channels including one channel for three different programmes and another for two programmes were asked to suspend transmission for duration ranging from one day to 30 days for telecasting content in violation of the Programme Code during the last three years and the current year.
This included 14 in 2013, one in 2014, four in 2015, and three in 2016 (till November), Rathore said.
The three in the current year are -- NDTV India and Care World India with one violation each, and News Time Assam for three violations. The orders relating to NDTV and Care World India have been challenged in the courts of law. Earlier, in 2014, Manoranjan TV was punished twice.
The channels punished in 2014 and 2015 are -- Enterr 10, Zing, Mahua, SS TV, AXN, FTV, Movies OK, Comedy Central, Zoom TV, ABN Andhra Jyoti, UTV Bindass, WB, NTV, Big CBS Love, Jai Hind, Al Jazeera, and Satlon News.
Action is taken against TV channels whenever any violation of the Programme and Advertising Codes is noticed or brought to the notice of the Ministry. The Ministry generally issues warnings or advisories to comply with the Codes or asks the channels to run an apology scroll on their channel.
But, Rathore said the channels are occasionally taken off air temporarily for a limited period depending on the gravity of the violation.

MIB restores TV channel licences of STV, Mahuaa following Delhi HC order
MUMBAI: The Ministry of Information & Broadcasting (MIB) has restored the licences of Mahuaa Media and STV Enterprises. This follows the order of Delhi High Court to restore the licences until further orders.
STV Enterprises’ four news licences have been restored, including Punjab Today, STV Jammu Kashmir News, STV Haryana News and STV UP News.
Mahuaa Media’s five licences have been reinstated, which include three news and two non-news licences. The three news licences are Mahuaa, Mahuaa News and First India, while the two non-news licences are Mahuaa Music and Mahuaa Movies.
Mahuaa’s licences were cancelled on 3 March while STV Enterprises’ licences were cancelled on 21 July. The reason for cancellation of licences of the two companies was denial of security clearance by the Ministry of Home Affairs (MHA).
The companies challenged the MIB’s cancellation order contending that the government has not stated the reasons for denying security clearance and the reasons cited for denying security clearance are untenable under law.
Passing an interim order on Mahuaa’s petition, the bench of Justice Manmohan allowed the company to uplink and downlink their TV channels.
To safeguard the interest of all the parties, the bench had directed Mahuaa not to transfer their shareholding or their licence or any of their assets without the leave of the court.
It also explained that the breach of national security is not attracted in Mahuaa’s case since the criminal cases are pending adjudication before the CBI courts.
Mahuaa promoters have been accused of cheating banks by borrowing huge amounts of money against forged and fabricated documents.
In the case of STV, the bench of Justice Sanjeev Sachdeva passed an ad-interim direction permitting the petitioner to uplink and downlink its channels.
The bench noted that prima facie the company is not directly connected with the issue reported by the MHA and that the matter may not amount to breach of national security.

HC seeks detailed govt order on Care World India's week-long ban
The Bombay High Court today said the Information and Broadcasting Ministry's order imposing a one-week ban against Care World India TV is not a ‘speaking order’ as it does not give details of the violations by the channel.
In view of this, Justice M S Karnik said that the Ministry should withdraw the show cause notice to the channel and issue a fresh order detailing violations. It gave time to the counsel for the Government to get instructions and inform the court by 30 November 2016.
Earlier, the court had extended the stay on the ministry order last week, after the TV channel informed the court that it wanted to amend its petition. The channel was required to satisfy the Court by today as to what amendments it wants to make.
Seven Star Satellite Pvt Ltd counsel Mayur Khandeparkar told the court in the last hearing on 8 November that a show-cause had been issued to the channel which had also been given a hearing by the Inter-Ministerial Committee, but the final order indicated that none of the arguments given by the channel had been taken into consideration and “therefore it is not a reasoned order”.
The ban had been put on the channel Care World from the midnight of 9 November to midnight of 16 November 2016.
Khandeparkar also said that the programme ‘Kya Karun main ab’ against which the ministerial order had come had already been taken off air and subsequent episodes would only come subject to the final order of the Court.
The judge also said in his order that the channel would not be permitted broadcast of this programme till its interim order was vacated.
